Terms of Service

1. Scope

These terms govern the use of the MILQ software, operated by Benjamin Thomet ("we"), by registered users ("you").

2. Subject of the agreement

MILQ is a web application for simple bookkeeping (income-expense accounting) for Swiss sole proprietorships. We provide the software; the substantive accuracy of your bookkeeping is your responsibility.

MILQ is not tax or legal advice. Guidance within the software and in the knowledge articles is for orientation only. Binding information can be obtained from the Swiss Federal Tax Administration, your cantonal tax office, or a fiduciary.

3. Trial period

After registration, you can use MILQ free of charge for 30 days with full functionality. No payment details are required, and there is no automatic renewal. If you do not take out a subscription, access ends after the trial period; your data remains available for export.

4. Subscription and payment

The subscription costs CHF 8 per month or CHF 84 per year, in each case including VAT. Payment is made in advance by card or TWINT; for annual payment, invoice is also an option.

If a payment is outstanding, we will inform you and set a grace period. After that, access may be suspended. Export of your data remains possible even then.

5. Cancellation

You can cancel at any time without notice from your account. The subscription continues until the end of the paid period. Amounts already paid are not refunded on a pro-rata basis.

We may terminate the agreement with 30 days' notice. In this case, we will refund the pro-rata amount for the paid period.

6. Your obligations

  • You keep your login credentials confidential.
  • You only enter data you are authorised to process.
  • You verify the values calculated by MILQ before submitting them to an authority.
  • You do not use MILQ for unlawful purposes.

7. Availability

We make every effort to ensure high availability but do not guarantee any specific uptime. We announce maintenance work whenever possible. Interruptions due to force majeure or disruptions at upstream providers are beyond our control.

8. Liability

We are liable for damages caused by intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. In particular, we are not liable for tax consequences, fines, or back payments arising from substantively incorrect bookkeeping.

9. Data

Your bookkeeping data belongs to you. We do not analyse it and do not share it with third parties. A complete export is possible at any time from your account. Processing is governed by our Privacy Policy.

After the agreement ends, we retain your data for as long as required by the statutory retention obligation of 10 years under Article 958f of the Swiss Code of Obligations, unless you request earlier deletion and no obligation prevents it.

10. Changes

We may amend these terms. Material changes will be communicated by email at least 30 days in advance. If you do not object by the effective date, the changes are deemed accepted. You may cancel on the effective date in this case.

11. Applicable law and jurisdiction

Swiss law applies, excluding conflict of laws provisions. The place of jurisdiction is Basel, unless mandatory provisions provide otherwise.
